With the arrival of July 31st 2026, officials at Texas DSHS have chosen to reinstate their original definition for what Hemp-derived cannabinoids are considered controlled substance within the lone star state. Unfortunately for consumers, this sweeping action relabels virtually all forms of THC from Hemp, including Delta 8, Delta 10, THCP, THCA, and many others.
We cannot overstate the seriousness of these developments: all Hemp-derived THC (other than Delta 9 in appropriate concentrations) will be recategorized as controlled substances in Texas, which can lead to fines and even more severe legal charges and consequences, including imprisonment, for those found to be in possession of such cannabinoids.
Does The Ban Affect Delta 9 Products Too?
Surprisingly, products which feature Delta 9 as their only form of THC and also meet the 0.3% concentration by dry weight requirement, remain available. While this is good news for responsible consumers, Hemp-derived Delta 9 is far from safe in Texas, where it still has many opponents who would seek its total removal as well.
So, for the moment, Delta 9 Gummies, Tinctures, and other Edibles are still allowed in Texas, provided they have appropriate concentrations of the embattled cannabinoid.
